3. Counter-Notification Procedures
If you receive a notification that material you posted on the Site has been removed or access to it has been disabled, and you believe this was done in error or as a result of misidentification, you may file a Counter-Notification. Your Counter-Notification must be a written communication sent to our Designated Agent that includes:
- Your physical or electronic signature.
- Identification of the material that has been removed and the location where it appeared before removal.
- A statement under penalty of perjury that you have a good faith belief that the material was removed as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or Los Angeles, California, if your address is outside the U.S.).
4. Repeat Infringer Policy
In accordance with the DMCA and other applicable laws, the Company has adopted a policy of terminating, in appropriate circumstances and at the Company’s sole discretion, users or account holders who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the Site or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
